The Defense and the Prosecution

Every person, guilty or innocent, has the right to a fair trial. Why is this one of the rights we are afforded as American citizens? Any comments about defending the guilty? Or even prosecuting the innocent? There have been many cases of wrongful imprisonment, especially with the technological advances and new DNA evidence. Make any comments you have on these or other opinions you have about our American justice system.

I personally think everyone should get a fair trial and nobody should be convicted until there is significant proof of being guilty. As American citizens we are afforded this right because everyone is innocent until proven guilty by a jury. I agree with this right 100 percent.

I think that everyone has a fair trial because of the fact that you may be innocent. Someone innocent should receive a fair trial just as someone who is guilty. I think that you should defend the guilty because if they are truly guilty they will be found guilty. I think that it is horrible that people have been wrongfully imprisoned but, they were in a fair trial that just happened to come out with wrong results. So obviously people have been wrongfully found innocent because why could it happen for one side but not the other.

We are afforded this because democracy applies to everything in this country not just presidential elections. people have the right to a fair trail because wrongful imprissonment is unpleasant?

Being guilty or innocent and having the right of a fair trial is one of the rights American citizins have because someone innocent should be able to throw a fair trail, to help prove themselves innocent. Imprisonment of an innocent person is a terrible thing, but if you are innocent or not, once the judge believes that you are guilty, it is hard to prove you are actually innocent.

Our founding fathers created a declaration of independence, constitution, and bill of rights to ensure Americans that they were ALL treated fairly. Every man has a right to a fair trial guilty or innocent because that is the fairness in our justice system. If someone defends a guilty person then that is perfectly fine because that is whats allowed. One thing i do not agree with though is that if someone is famous or has a lot of money, they believe that they can get away with anything. For example OJ Simpson was claimed to not have killed his wife but it is almost conclusive that he did. Prosecuting an innocent person is just unfortunate. Sometimes that is the wrong doing of our justice system but that is considered a fair trial.

I agree with Jamie that eeryone should have the right to a fair trail. Now that there is DNA tests you can not get any fairer then that. If your DNA is found at the scene and it matches, you are obviously guilty because science wins.

The judicial system is very corrupt. Lawyers have the power of make anything look however disregarding the truth. I think its wrong for a lawyer to defend a man he knows is guilty. What kind of system would you believe in if you did not hold truth heighest in your practice. The design of a fair trial is vital to this country however there still is the loop hole of lying and getting a good lawyer. In todays society a good lawyer can get you out of anything.

In my opinion everyone should get a fair trial no matter if you are innocent or not. The lawyers should go the end and try to do their best to prove that a person is not guilty because that is their job and they get paid for it. If the person ends up guilty of whatever they have done there is nothing you can do about it. True is true.

I believe that the current leagal system is not completely fair, but it never will be. Their are so many advansments if you look at it now then used to be. It is way more fair. One of the biggest reasons why it is fair is because of the diversity in the country, so the jury is not one sided.

There is a quote used in the court system "innocent until proven guilty" This means that every person that is tried is presumed innocent until the prosecutor has proven beyond reasonable doubt that he is guilty. We have the right by the constitution that we have a right to a fare trial and to uphold the justice system that must hold true. Even with all the technological advances citizens are still put in jail for something they did not do. Even though the justice system is better and more fare that it was before there are still flaws that make it a difficult process. i think that there is to much corruption in the justice system starting as far down as the police who patrol that cities up the judges who pass laws. Corruption must be stopped to preserve that integrity on the justice system.

i feel that everyone does deserve a fair trial. i feel that many of our trials today are not fair. if a person cannot afford an attourney they are given a attourny that doesnt care at all about their case and doesnt care if they get the death penality. i feel that gov. appointed attourneys should only have one case at a time to actually focus on the case they have.

It is good that in this country you are innocent untill proven guilty. Having a fair trial is a very important part of the law system and is why america has arguably the best law system in the world. It is better to have 10 guilty people go free than have 1 innocent person locked up. It is these types of morals that america holds true to which has made helped our legal system become what it is today.
